for Kitepower El Gouna (Egypt) and Kite4all s.r.o. (EU)

Wind Guarantee & Refund Policy
Kitesurfing depends on the wind, so our policy is built around it. We do not refund payments — by any method, whether you paid in cash, by card, bank transfer or online — instead, we protect every hour you have paid for:
- Wrong wind? If the wind is too light or too strong to teach safely, we reschedule your lesson to another time the same day, or to the next day.
- Unused hours never expire. Any hour you cannot use stays as credit on your account with no deadline — come back next week, next season or years later.
- Or a voucher instead. If you prefer, we convert unused hours into a voucher of equal value that you or a friend can use later.
This applies to lessons that cannot run because of the weather, and to hours you have paid for but not yet used. It is why booked hours never expire. Questions before you book? Message us on WhatsApp.
1. General Information
These General Terms and Conditions regulate the participation in courses, rentals, and other services provided by Kitepower El Gouna (FRZ 14, El Gouna, Egypt) and Kite4all s.r.o. (Kpt. Jaroše 1844/28, 602 00 Brno, Czech Republic).
- Kite4all s.r.o. acts as the European partner and booking/payment intermediary for customers booking via the GoPay payment gateway.
- Kitepower El Gouna is the service provider and operator of the kitesurfing center in El Gouna, Egypt.
By booking, registering, or participating in any service or event organized by Kitepower El Gouna, the participant accepts the following terms and conditions.
2. Conditions of Participation
Kitesurfing and wingfoiling are high-risk sports. Participation is entirely at the participant’s own responsibility and risk.
- The participant acknowledges the risk of personal injury and property damage to themselves or others.
- The participant must follow the instructions of instructors and staff immediately and unconditionally.
- In case of improper or unsafe conduct, the organizer assumes no liability for injuries or damages.
- Each participant confirms they are physically and mentally fit to participate and have no health issues that could endanger themselves or others.
- We recommend consulting a doctor before participating if there are any health concerns.
- All participants must be able to swim at least 15 minutes in open water without flotation aids.
Kitepower El Gouna reserves the right to refuse participation for safety or health reasons.
3. Registration
- Registration for courses, rentals, or storage must be done in writing or via the official online form.
- For minors, written consent from a legal guardian is mandatory.
- By submitting a booking, the participant confirms agreement with these Terms and Conditions.
4. Withdrawal by the Participant
Participants may withdraw from their booking at any time by written notice.
The date of receipt of the written notice determines the applicable cancellation fee.
Cancellation Fees
- up to 30 days before arrival – 10 % of total price
- 29 to 20 days – 25 %
- 19 to 10 days – 50 %
- 9 to 4 days – 65 %
- 3 days (72 h) before arrival – 85 %
- same day / no-show – 100 %
We do not refund payments by any method (cash, card, bank transfer or online). Any balance remaining after the applicable cancellation fee stays as credit on your account (which never expires) or is converted into a voucher of equal value — see our Wind Guarantee & Refund Policy above.
5. Cancellation by the Organizer
Kitepower El Gouna may cancel participation if:
- a participant seriously disturbs the course, violates safety rules, or endangers others;
- weather or technical conditions make operation unsafe;
- force majeure (natural events) occurs.
Payments for unused services are not refunded by any method (cash, card, bank transfer or online). They stay as credit on your account (which never expires) or are converted into a voucher of equal value. 6. Business Hours and Payments
- Kitepower El Gouna operates daily from 09:00 until sunset (approx. 18:00).
- For safety reasons, kitesurfing is not permitted outside opening hours, as rescue and supervision services are unavailable.
- All payments must be settled before 17:00 (local time) on the same day.
7. Participant’s Duty to Cooperate
Participants are expected to behave responsibly, follow instructions, and report any incidents or equipment damage immediately.
Failure to cooperate or intentional misuse may lead to exclusion without refund.
8. Safety Rules and Implementation Conditions
- The Kitepower El Gouna beach is a private area. All visitors must follow KP staff instructions and posted beach rules.
- Kite launching and landing are only permitted at the water’s edge with assistance.
- Flying kites on land is strictly prohibited.
- International right-of-way rules (VDWS / IKO standards) apply.
- Jumping or riding close to shore is not permitted.
- Rescue support is available only during operating hours and is assessed for the actual situation; a specific intervention or response time is not guaranteed, and operation may be limited at low tide.
- Kiting beyond the visible area (~1 km offshore) is at your own risk.
- In any rescue, saving human life has priority over equipment. KP assumes no liability for material damage during rescues.
9. Duty of Care for Equipment
- All Kitepower equipment is regularly inspected and maintained.
- Each renter must check equipment before use and report any defect immediately.
- Equipment must not remain on the beach longer than 15 minutes.
- If left unattended, KP staff may remove and store it.
- Negligent or intentional damage voids insurance coverage, and the participant is financially responsible for repair or replacement costs.
10. Liability and Disclaimer
Kitepower El Gouna and Kite4all s.r.o. act with professional care but assume no liability for:
- personal injuries or property damage resulting from participation;
- loss, theft, or damage to personal belongings (including items in lockers);
- delays or interruptions caused by weather, technical issues, or force majeure.
Participants are responsible for their own insurance coverage (health, accident, travel, liability).
All activities are undertaken at the participant’s own risk.
11. Rental Conditions
- Equipment rental requires proof of sufficient skills (IKO / VDWS level 3 or equivalent).
- Instructors may revoke rental rights if unsafe behaviour is observed.
- Rental fees exclude material insurance.
- Optional damage insurance is available: €15/day for 1–2 days, €10/day for 3+ days (covers one incident per week up to €200 per rider).
- In cases of negligent loss or damage, the customer is liable for full repair or replacement cost.
12. Course Conditions
- Courses typically start at 09:00 on the first booked day.
- If the wind is too strong (> 30 knots) or too weak (< 10 knots) to teach safely, lessons are rescheduled to another time the same day or the next day. Hours that still cannot be used stay as credit that never expires, or a voucher of equal value — we do not refund payments by any method (cash, card, bank transfer or online; see our Wind Guarantee & Refund Policy).
- If the student ends the course early for personal reasons, the unused hours stay as credit or a voucher; they are not refunded.
- Participants must follow instructor directions at all times.
- Group lessons are taught at a ratio of 1 instructor : 2 students.
- If a student is alone, the effective lesson duration may be reduced accordingly PRIVATE LESSON.
The participant acknowledges the inherent risks of kitesurfing, including possible injury to self or others.
KP assumes no liability for such incidents during lessons.
13. Children and Minors
- Children under 15 years may participate only with a legal guardian who is also present.
- Youth aged 15–18 require written parental consent.
- The guardian assumes full responsibility for the minor’s actions.
14. Severability Clause
If any provision of these Terms is found invalid or unenforceable, the remaining clauses remain in full effect.
Such provision shall be replaced by one reflecting the original intent as closely as possible.
15. Applicable Law and Jurisdiction
- Contracts concluded via Kite4all s.r.o. are governed by Czech law.
- Services rendered in Egypt are subject to Egyptian law.
- In case of disputes, both parties agree to seek an amicable settlement before any legal action.
